What are the rights and obligations of CNAS and accredited conformity assessment bodies?

CNAS has the following rights and obligations towards accredited conformity assessment bodies:

(1) CNAS has the right to periodically supervise the activities carried out by accredited conformity assessment bodies and the use of accreditation certificates and accreditation marks/joint marks.


(2) CNAS has the right to conduct on-site investigations and follow-up investigations on approved qualified assessment institutions based on complaints from relevant parties, and to make rectification requirements accordingly.


(3) CNAS has the right to make decisions to suspend, restore, or revoke accreditation qualifications for accredited qualification assessment agencies that do not comply with CNAS regulations.


(4) CNAS has the obligation to use its website to publicly disclose the accreditation status information of accredited conformity assessment agencies and update it in a timely manner.


(5) CNAS has an obligation to provide information on appropriate measurement traceability pathways related to the scope of accreditation to accredited conformity assessment bodies.


(6) CNAS has an obligation to provide information on the signing of relevant international multilateral recognition agreements and other international arrangements.


(7) CNAS has the obligation to promptly notify the accredited conformity assessment bodies when there are changes in accreditation requirements, and to listen to the opinions of all relevant parties before making a decision on the content and effective date of the changes, so that the accredited conformity assessment bodies can make adjustments within a reasonable period of time.


(8) CNAS has the obligation to promptly provide new versions of accreditation rules, guidelines, and other relevant documents to qualified assessment institutions that have applied for/been approved for accreditation. It is planned to promote and train qualified assessment institutions on accreditation knowledge, actively seek opinions from qualified assessment institutions, and pay attention to collecting relevant information feedback from qualified assessment institutions in accreditation work at any time to promote the continuous improvement of CNAS accreditation system.


(9) In order to understand the needs of qualified assessment institutions and potential customers, CNAS has the obligation to respond promptly to relevant accreditation inquiries, establish effective information dissemination and customer feedback systems, and meet the needs of qualified assessment institutions through organizing publicity and training activities.


(10) CNAS has an obligation to comply with the requirements of international and regional recognized multilateral mutual recognition agreements and not to compete with recognized institutions that have already joined the mutual recognition agreements.



Approved qualified assessment institutions have the following rights and obligations:



(1) Approved qualified assessment institutions have the right to promote within the prescribed scope that their corresponding technical capabilities have been recognized.


(2) Approved qualification assessment agencies have the right to use the accreditation mark/joint mark on certificates or reports issued within their scope of accreditation, as well as on proposed advertisements, special letterheads, and promotional publications.


(3) Approved accreditation bodies have the right to file complaints about the work of CNAS staff and reviewers, and have the right to appeal decisions related to accreditation made by CNAS against them.


(4) Approved qualified assessment institutions have the right to voluntarily terminate their accreditation qualifications.


(5) Approved accreditation bodies have an obligation to ensure that their operations and services continue to comply with the accreditation conditions specified in the accreditation rules.


(6) Approved qualified assessment institutions have the obligation to consciously comply with relevant laws and regulations.


(7) Approved qualified assessment institutions have the obligation to provide necessary support for the CNAS Secretariat in arranging review activities, and to facilitate access to the reviewed area, record checking, witnessing on-site activities, and contacting staff for relevant personnel. They shall not refuse personnel sent by the CNAS Secretariat to witness review activities (including international peer review witnesses).


(8) Approved qualified assessment agencies shall participate in the proficiency testing, laboratory comparison, or measurement audit activities designated by the CNAS Secretariat.


(9) Approved qualified assessment institutions shall be responsible for the certificates or reports (including but not limited to test data, opinions, and explanations) issued by them, and shall keep them confidential for customers.


(10) Approved qualified assessment institutions have an obligation to establish a customer complaint handling procedure. If they fail to satisfy the relevant parties within 2 months after receiving the complaint, they should notify the CNAS Secretariat of the summary and handling process of the complaint.


(11) Approved qualified assessment institutions have the obligation to promptly notify the CNAS Secretariat in writing of any changes that occur; It is the obligation to make adjustments in accordance with CNAS requirements when there are changes in accreditation requirements, and to notify the CNAS Secretariat after the adjustments are completed.


(12) Approved qualified assessment institutions have the obligation to be fair and honest, not engage in fraud, and not engage in any activities that damage the reputation of CNAS.


(13) Approved conformity assessment bodies have an obligation to comply with CNAS regulations when indicating their accreditation status in their certificates, reports, or promotional media, such as advertisements, promotional materials, or other occasions.


(14) Approved qualification assessment institutions have the obligation to immediately return their accreditation certificates, cease using accreditation marks/joint marks on certificates, reports or promotional materials, and not use any means to indicate that their accreditation qualifications are still valid when their accreditation is revoked or voluntarily cancelled by CNAS, or when the period of accreditation indicated in the accreditation certificate (or accreditation decision) expires.


(15) Approved qualified assessment institutions have the obligation to frequently browse the CNAS website and obtain timely information on accreditation status, accreditation requirements, and other related information.


(16) Approved qualified assessment institutions have the obligation to pay fees in accordance with relevant regulations.
