Recently, the California Office of Environmental Health Hazard Assessment (OEHHA) added Bisphenol S to the California 65 Hazardous Substances List, adding it due to reproductive toxicity. The 2023 California 65 Hazardous Substances List has been updated five times to include a total of 12 substances. Under the California 65 control requirements, manufacturers and distributors are required to complete enforcement of warnings within 12 months after a new substance is added to the list and terminate the discharge of the chemical to drinking water sources within 20 months. After this date, governmental or individual enforcers, including individuals or organisations representing the public interest, may bring suit against violators of the regulations. Products containing the added substances will likely face litigation, incurring hefty fines.
